In accordance with Art. 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (General Regulation on the Protection of Personal Data) and 11 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, personal data, provided through the forms offered on the portals of the Ministry of Labor, Migration and Social Security and their associated electronic headquarters, will be treated in accordance with the regulations in force for each Treatment Activity whose characteristics are collected in accordance with article 30 of the Reglamento en el Registro de Actividades de Tratamiento del Ministerio de Inclusión, Seguridad Social y Migraciones. In the inventory of activities you can find detailed information on: the person responsible for each processing activity, the purpose, legitimacy, conservation of personal data, and on the possible transfer or international transfer of data.
The legitimacy of the treatment may be based on the fulfillment of a mission carried out in the public interest or on the exercise of public powers conferred on the person responsible for the treatment, on the fulfillment of a legal obligation, on the consent of the interested persons, or on any of the other causes assessed in article 6 of the General Regulation on the Protection of Personal Data (RGPD). In the case of processing activities that process data of special categories, the authorization may be based on any of the causes assessed in article 9 of the RGPD or of the Organic Law 3/2018 (on Data Protection and Guarantee of Digital Rights). The Ministry of Inclusion, Social Security and Migration undertakes to keep the maximum reserve and confidentiality on the information provided to it and to use it only for the purposes established for each treatment.
The data will be collected through the corresponding forms, which will only contain the essential fields for the processing of the benefits or services that are requested, and will be kept for the time necessary to attend the services, based on current legislation, regarding the prescription of responsibilities. It is up to the interested party to update their own data; the Ministry of Inclusion, Social Security and Migration shall not be liable for its inaccuracy if any changes that may have occurred are not communicated.
You can exercise your rights in data protection: access, rectification, opposition, deletion, limitation of treatment, portability, and not to be subject to automated individual decisions, when appropriate, through postal mail addressed to the Ministry of Labor, Migrations and Social Security, at Paseo de la Castellana, 63, 28071 Madrid or through the email dpd@mitramiss.es.
